Your ex cannot withhold your court ordered visitation if you are behind in your child support. Doesn’t matter if you’re behind a day, a week, five years. the point is that you have a court order that says you are supposed to see your child on whatever the days are. that is a court order that she must abide by. That’s a separate issue from whether or.
Not you’re supposed to be paying child support. IF you’re supposed to be paying child support, whether or not you’ve had a loss of your job, a drop in your income is not relevant to whether or not you’re supposed to pay child support. If there’s a court order for you to pay X amount of dollars per month you must pay that. If you need to go in and have that changed because of you’ve suffered a drop in your income or the loss of a job, you have to go in and start doing that process, but that’s a separate issue from whether or not your ex can withhold your opportunity to have a relationship with your child.
